We disclaim all liability for any incidental, consequential, or indirect damages arising from your use of the App or related services, including but not limited to loss of data, unauthorized access, or service interruptions.

The App and related services are provided "as is" and "as available," without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability or fitness for a particular purpose. Your decision to use the App or related services constitutes your acceptance of these terms, including all disclaimers of liability stated herein. This Privacy Policy does not create or confer upon any individual or third party any rights, remedies, or other benefits beyond those explicitly outlined.

Furthermore, any disputes arising from the interpretation or enforcement of this Privacy Policy are limited to the maximum extent permitted by applicable law. For the purposes of this Privacy Policy, "personal data" refers to any information relating to an identified or identifiable individual, including but not limited to names, email addresses, profile information, and other demographic or behavioral information collected through the App or related services. This Privacy Policy applies to the Drop N Launch application, website, public web app, public player profile pages, public leaderboards, and related services, and does not govern interactions with any third-party services or resources accessed through the App or related services.

Such interactions are governed by the privacy policies of their respective providers, and we disclaim any responsibility or liability arising from their use. By continuing to use the App or related services, you signify your irrevocable acceptance of this Privacy Policy in its entirety.

INFORMATION WE COLLECT

**Account Information:** When signing up or logging in to the App, users are required to authenticate using Apple or Google credentials. This process is governed by the respective privacy policies of Apple or Google, and we disclaim any responsibility for their data collection practices. Upon successful authentication, users may optionally provide additional account details, including a name or nickname, birthdate, height, weight, and baseball or softball skill level.

The provision of these details is entirely at the user's discretion and is not mandatory for using the App unless a specific feature requires that information. Users are encouraged to use nicknames if they prefer to remain anonymous. The App does not verify the authenticity of the data provided, and users are solely responsible for the accuracy of their submissions.

Drop N Launch may also collect or store player profile information that you choose to provide, including first name, last name, player handle, sport, graduation year, country, state or province, city, batting stance, throwing arm, positions, teams and clubs, team links, social links, and other player profile information. Drop N Launch may support primary profiles and family player profiles. Family profiles may be managed by the account owner, parent, guardian, or other authorized user.

**Performance Data:** The App collects baseball and softball swing metrics during gameplay or training sessions. These metrics may include, but are not limited to, swing speed, launch angle, ball exit velocity, distance, and other performance-related data. Such data is collected exclusively for delivering personalized feedback, tracking progress, displaying stats, calculating rankings, and enhancing the user's experience within the App and related services.

Aggregated data, such as trends derived from swing metrics, age, height, and weight, may also be used for research, development, or marketing purposes. This aggregated data does not include personally identifiable information.

**Device Information:** To ensure optimal functionality and compatibility, the App may collect technical data related to the user's device, including but not limited to device type, operating system version, unique device identifiers, and diagnostic information. This data is used solely to troubleshoot technical issues, improve the App's performance, and maintain compatibility with supported devices.

**Support and Reports:** If you contact support or report a public profile, leaderboard issue, vulgar content, profanity, impersonation, inaccurate information, or another concern, we may collect your email address, message content, the page, profile, leaderboard, or issue being reported, and any other information you choose to include.

PUBLIC PROFILES, PLAYER HANDLES, AND LEADERBOARDS

Profiles are private by default.

A profile becomes public only when the account owner uses the public profile control in the App and confirms that they want to make the profile public. Links to this Privacy Policy and the User Agreement are shown near that control.

When a profile is private, Drop N Launch may still include the player in leaderboard calculations in a masked format. For example, a private profile may appear as "Private Profile" while showing limited ranking information such as age division, rank, and max exit velocity. Private profiles do not show a public handle, public profile page, name, city, state, country, teams, social links, or other identifying public profile details.

When a profile is public, Drop N Launch may publish a public player profile page and may show identifying profile information on public leaderboards. Public profile information may include player handle, display name, initials, sport, age division, graduation year, country, state or province, city, positions, batting and throwing information, selected performance stats, ranking information, teams and clubs, team links, and social or player profile links that the user chooses to provide.

Birthdate is treated as private profile information. We may use birthdate to calculate age division for profiles and leaderboards, but we do not display the player's full birthdate on public profile pages or public leaderboards.

If public profile visibility is turned off, the public profile page may become unavailable and leaderboard rows may return to a masked private format. Some cached pages, search results, screenshots, shared links, or previously viewed pages may take time to update or may remain outside Drop N Launch's control.

Users may choose a public player handle. Handles are used for public profile URLs and public identity in Drop N Launch. We may screen handles and public profile information for profanity, vulgar terms, impersonation, brand misuse, misleading content, or other prohibited content. We may reject, remove, hide, or change public visibility for content that violates our policies or creates a safety, privacy, or moderation concern.

Public visibility for family profiles should be controlled by the parent, guardian, or account owner. If you create, manage, or publish a family profile or a profile for a minor, you represent that you are the parent, legal guardian, or otherwise have permission to manage and publish that player's profile information.

DATA STORAGE AND SECURITY

All information collected by the App is securely stored using industry-standard encryption and access controls to protect against unauthorized access, alteration, disclosure, or destruction. Despite these measures, no method of data transmission or storage can guarantee absolute security. By using the App or related services, you acknowledge and accept these inherent risks.

No data collected by the App will be sold, rented, or otherwise shared with third parties, except as explicitly outlined in this Privacy Policy or when required by applicable law. Aggregated and anonymized data used for analytics, research, or marketing purposes will be stripped of personally identifiable information to ensure user privacy.

VIDEO STORAGE AND BACKBLAZE

In addition to Firebase, we store certain user-generated videos with Backblaze B2 Cloud Storage ("Backblaze") to enable cross-device access and backup. By using the App, you consent to the storage of these videos on a third-party service. Backblaze applies its own security measures, including encryption in transit and at rest, to protect your data. However, we do not control Backblaze's internal security policies or guarantee their performance.

**Purpose of Video Storage:** Videos are stored in Backblaze so users can access their content across different devices and maintain a secure backup of their recordings.

**Disclosure:** We do not share or sell user videos to any unrelated third parties. Authorized personnel may access user videos in Backblaze only to address technical issues, enforce our terms, or comply with legal obligations.

By continuing to use the App, you acknowledge that Backblaze's services and terms may differ from our own, and we disclaim liability for any breach or data handling error originating at Backblaze.

USER RESPONSIBILITIES

Users are responsible for maintaining the confidentiality of their login credentials and ensuring the accuracy of the data they provide. The Company assumes no liability for errors, omissions, or damages arising from inaccurate data submissions or unauthorized access to user accounts.

Within the App, you may also assign a coach to your profile by linking the coach's email to your account. By designating a coach, you grant that individual the ability to view, update, create, and delete certain performance data associated with your account, including but not limited to baseball and softball swing metrics.

You acknowledge and agree that: (1) it is solely your responsibility to select and authorize a coach you trust; (2) you bear all risks arising from the coach's actions regarding your data once access is granted; and (3) the Company disclaims any liability for the coach's misuse or unauthorized disclosure of your information.

You are responsible for any profile information, team information, club information, social links, team links, player handles, and other content you provide or publish through Drop N Launch. You should not make a profile public unless you are comfortable with that information being visible to others.

HOW WE USE YOUR INFORMATION

The information collected through the App is utilized strictly for the purposes of delivering, maintaining, and improving its functionality, as well as ensuring a seamless and personalized user experience.

Specifically, we use your information to:

- authenticate and manage your account;

- provide tailored feedback based on performance metrics;

- deliver features most relevant to your profile and preferences;

- save, display, and update player profile information;

- calculate age divisions and leaderboard rankings;

- operate public player profile pages and public leaderboards;

- mask private profiles while preserving leaderboard ranking integrity;

- provide support, troubleshooting, moderation, and account assistance;

- analyze and improve App functionality using aggregated or anonymized data.

Aggregated and anonymized data derived from swing metrics and other collected information is used exclusively for internal research, development, and marketing purposes, and does not include any personally identifiable information. We do not sell your personal data or share it with unauthorized third parties. If data sharing is necessary, it is strictly limited to the scenarios described in this Privacy Policy or as mandated by applicable law.

We may use your contact information, such as your email address, to send you important service-related communications and, where permitted by applicable law, occasional product updates, feature announcements, and promotional offers related to Drop N Launch and compatible hardware, for example discounts on launch monitors or app subscriptions.

You may opt out of receiving non-essential marketing communications at any time by adjusting your preferences in the App settings or by using the unsubscribe link included in such emails.

SHARING YOUR INFORMATION

We limit the sharing of your personal data to the circumstances explicitly described below. Under no circumstances do we sell, rent, or disseminate your personally identifiable information to third parties for their own marketing or commercial purposes.

- **Service Providers:** We may share your information with trusted third-party service providers, including cloud storage such as Firebase and Backblaze, who assist us in operating the App and related services. These providers are contractually bound to use your data only as directed and to keep it confidential.

- **Public Profiles and Leaderboards:** Public profile and leaderboard information is visible to anyone when a profile is made public. Masked private leaderboard information may be visible in limited form, such as "Private Profile," age division, rank, and max exit velocity.

- **Legal Obligations:** We may disclose your data to governmental authorities or other third parties if required by law or in response to valid legal requests.

- **Aggregated or Anonymized Data:** Non-identifiable, aggregated data may be shared with third parties for research, analysis, or marketing.

DATA RETENTION

If your subscription lapses and your account remains inactive for 30 consecutive days, we will delete your data from our cloud services, including your stored videos, unless otherwise required by law or necessary to comply with legal obligations.

**Performance Data:** May be retained in aggregated or anonymized form indefinitely for analytical, research, or marketing purposes. Once anonymized, such data will no longer be associated with any identifiable user.

**Public Profile and Leaderboard Data:** Public profile pages and leaderboard entries may be retained or updated as needed to operate the public web app, preserve leaderboard ranking integrity, comply with legal obligations, resolve disputes, enforce agreements, or process privacy and moderation requests. If public profile visibility is turned off, public profile pages may become unavailable and leaderboard rows may return to a masked private format, subject to processing time and caching.

**Device Specific Data:** Retained only as long as necessary for troubleshooting, compatibility, and functionality improvements.

If you choose to delete your account or request the deletion of your personal data, we will make reasonable efforts to remove your data promptly, subject to any legal or regulatory retention requirements. Aggregated or anonymized data may be retained without time limitation, as it no longer identifies you personally.

## CHILDREN'S PRIVACY POLICY

We do not knowingly collect or solicit personal information from children under 13 without the necessary consent. If we become aware that a child under 13 has provided us with personal data without the necessary consent, we will take immediate steps to delete such information from our systems. Parents or guardians who believe their child has provided us with personal information are encouraged to contact us promptly so we can address the issue.

- **Communication Preferences:** You can manage or opt out of non-essential communications within the App settings.
